End User License Agreement for Twop iOS Application

This EULA is a contract between you (“User”) and MuseumMate, S.L.U. relating to the mobile application TWOP (the “App”). By installing or using the App, you fully accept this EULA. If you do not agree, do not install or use the App.
This EULA complements (and does not replace) the Terms of Use and the Privacy Policy of TWOP. In case of conflict regarding license/use aspects of the software, this EULA prevails.
1. License
We grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the App only on devices that you own or control, for personal and non-commercial purposes, and in accordance with this EULA, the Terms of Use and the usage rules of the store from which you downloaded it.
2. Restrictions
You may not, nor allow others to: (a) copy, distribute or make the App available except as permitted by this EULA; (b) decompile, disassemble or perform reverse engineering (except to the extent that the law permits); (c) rent, lease, sell, sublicense or transfer the App; (d) circumvent technical protection measures; (e) use the App in a manner contrary to law, the Terms of Use or the Community Guidelines.
3. Intellectual property
The App (code, designs, trademarks, databases and proprietary content) is owned by TWOP or its licensors and is protected by intellectual property laws. This EULA does not confer any property rights to you regarding the App, only the usage license described.
4. User-generated content (UGC)
The UGC you publish is governed by the Terms of Use. You retain your rights to your content, granting TWOP the necessary licenses to operate the service. You are responsible for ensuring your UGC complies with the law and third-party rights.
5. Third parties, SDKs and external services
The App may incorporate libraries/SDKs and link to third-party services (e.g., maps, analytics, advertising, store payments). These services are governed by their own terms and policies. TWOP is not responsible for the content or privacy practices of third parties.
6. Updates and changes
We may provide updates (patches, improvements, new features). Some may install automatically. The use of the App after an update signifies your acceptance. We may modify or discontinue features for technical, legal or business reasons.
7. Maintenance and support
TWOP provides reasonable support and maintenance of the App. The stores (Apple/Google) are not obligated to provide support for the App except as provided in their terms.
8. Warranty
The App is provided “as is” and “as available”. To the extent permitted by law, we exclude warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in this EULA limits any non-waivable rights you may have as a consumer.
9. Liability
To the extent permitted by law, TWOP shall not be liable for loss of profits, indirect damages, special or consequential damages arising from the use or inability to use the App. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or in circumstances where the law prohibits such limitation.
10. Indemnity
You agree to indemnify and hold harmless TWOP against claims from third parties arising from the improper use of the App or from a breach of this EULA, the law, or the rights of third parties, to the extent permitted by applicable law.
11. Duration and termination
This EULA governs from installation and remains in effect until its termination. We may suspend or terminate your license if you breach this EULA, the Terms or the law. You may terminate it by uninstalling the App and ceasing to use the service. Upon termination, your right to use the App ceases.
12. Export and sanctions
You declare that you are not located in a country subject to embargo or applicable international sanctions nor are you on any restricted party lists. You agree to comply with all applicable export and sanction control regulations.
13. Data protection
The processing of personal data is governed by the Privacy Policy of TWOP. Some features (e.g., analytics, advertising, location) may require your consent. You can manage your options in Settings → Privacy.
14. Platform-specific provisions
14.1. iOS (Apple)
a) Recognition: this EULA is between you and MuseumMate, S.L.U., not with Apple.
b) Scope of the license: your use of the App must comply with the App Store Rules of Use.
c) Maintenance and support: TWOP is responsible for providing support for the App; Apple does not have any support obligation.
d) Warranty: if the App does not meet any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). Apple does not assume any other warranty obligation regarding the App.
e) Product claims: TWOP is responsible for addressing claims regarding the App (e.g., compliance, product liability, legal compliance). Apple is not responsible for such claims.
f) Third-party intellectual property rights: TWOP is responsible for investigating, defending, resolving, and satisfying any claim that the App or your ownership/use infringes the rights of third parties.
g) Legal compliance: you declare that you will not use the App in violation of applicable laws or regulations (including territorial and content restrictions).
h) Third-party beneficiary: Apple and its affiliates are third-party beneficiaries of this EULA and may enforce it against you to the extent applicable.
15. Open Source and third-party components
The App may include components under open source licenses or other third-party licenses. Their terms shall prevail regarding such components in case of conflict. We will make available the notices and texts of those licenses where appropriate.
16. Modifications of the EULA
We may update this EULA for legal, technical, or business reasons. We will notify you of substantial changes with reasonable notice. Continued use after such changes take effect signifies acceptance.
17. Governing law and jurisdiction
This EULA is governed by Spanish law, without prejudice to the mandatory laws of your country of residence. Disputes will be submitted to the competent courts of your domicile as a consumer or to those applicable under the law.
